How long does it take for a house sale and purchase to complete?

It takes around 6-8 weeks for a sale and purchase transaction to complete. However, complex deals may take longer. Neither the buyer nor the seller is legally bound to go through with the transaction until contracts exchange. By then, all the property searches will have been completed, the title checked, and questions from both sides answered.

What is the difference between joint tenants and tenants in common?

If you are buying a property with a partner, relative or friend, determining whether the property will be owned by all, as joint tenants or tenants in common, is necessary.

Joint tenants implies all purchasers own the land and any buildings on it in a 100% equal shares; therefore, they act as a single owner. Upon the death of one of the owners, the entire ownership of the property automatically transfers to the surviving purchaser. This is known as the ‘right of survivorship.’

If you purchase property as tenants in common, each purchaser owns a specified portion of the property. The shares do not have to be equal. There is no ‘right of survivorship; each purchaser can dispose of their share of the property as they wish through their Will.

Organise Home Buyer’s survey and a mortgage (if required)	Your Solicitor will ask you to complete a series of questionnaires about the property. These will cover details such as what fixtures and fittings will be left in the property (i.e. whiteware, curtains etc.), if there have been any disputes with neighbours or the local authority, and information regarding council tax.
The Solicitor will examine the title, determine whether the property is leasehold or freehold, and send any questions concerning the title to the seller’s Solicitor	A draft contract will be prepared by your Solicitor.
After receiving the contract, your Solicitor will undertake searches on the property such as Local Authority Searches, Water and Drainage, and Environmental. If any questions result from these searches, they will be sent to the seller’s Solicitor for response	Your Solicitor will respond to any questions from the buyer and will advise you to organise any appropriate surveys/inspections required in light of information obtained in the searches or Home Buyers report.
Your Solicitor will send you a report detailing all the information contained in the searches, answers to any questions, your mortgage offer, and the total amount you must pay on the property	Request a redemption figure from your mortgage lender.
Exchange of contracts takes place. This is done on a specific date, and both Solicitors will check that the contracts they have are identical and signed. Once exchange takes place, you are legally obliged to complete the transaction. If you pull out, you will be liable for damages. At this point, the deposit is paid to the seller’s Solicitor. A completion date will be set. On completion day, the full balance of the purchase price will be paid to the seller’s Solicitor. The keys will be given to the Estate Agent, and you are free to move in.	On completion day, you will receive the outstanding balance of the sale price. You need to hand over the legal documents that prove ownership and pay off the mortgage with the proceeds of the sale. Leave one set of keys with the Estate Agent and any spares at the property.
